Terms of ServiceGENERAL
- By ordering a commission you agree to these Terms of Service and Privacy Policy. I have the right to take action if a breach of terms is detected.
- I, the artist, reserve the right to not accept your commission order without reason or explanation.
- I have the right to alter my Terms of Service at any time. New terms will not apply retroactively.
- The product is a digital .png file and does not require shipping. If another type of file is required, it must be specified.
- Unless specified, the art is in Procreate's RGB colour profile with a dpi of 130. Canvas sizes vary.
- Price varies for different types of commission and the licensing tier (personal, semi-commercial or commercial use)
- If you are a "small" creator, even while monetised, the commission will be charged as "personal use".
- An Art Commission Agreement may be requested by the client or artist and will always have to be signed by both parties.
- Commissions over the value of 50€ and any commercial commission always require an Art Commission Agreement to be signed by both parties.LIMITATIONS
- I will draw humanoid ocs, minecraft ocs, furry, feral, anthro, people's pets, you & your friends, fanart.
- I will not draw NSFW, mech, heavy gore or anything I deem inappropriate or outside of my capabilities.
- Please ensure that your reference is clear on things like skin colour, body type, etc. If not, inform me of the specifics.CREATION PROCESS
1.) The client orders a commission. Client and artist talk about the specifics (references, poses, colours, etc.)
2.) Upon accepting the commission, the artist will give a preliminary quote on the final price. This price remains subject to minor change.
3.) The client will receive a sketch for approval and has the right to full revision at this stage. After any revisions are made, the artist will communicate the full final price. Revisions after this stage will be refused.
4a.) An invoice is sent. Upon full payment, the artist continues.
4b.) If the commission is an illustration, with an ongoing hourly rate, payment happens at the end.
4.1) If so desired by the client, updates at any point of the process may be sent
5.) The client is shown a lowres finished piece and, if no minor adjustments are requested, a finished HQ wetransfer download link to the finished piece.- The artist reserves the right to decide which changes are free of charge.
- Turnaround time varies between 2 hours to 2 weeks from when the commission is accepted, unless specified otherwise.
- Deadlines may be communicated. Deadlines may be refused. Deadlines may increase the price (5-25% rush fee).
- There may be variations in style which I apologise for but cannot avoid. I, as the artist, will stick as closely to the desired style as possible.ORDERING
- Ordering may be done via VGen or twitter/Discord DMs.
- Commission description should contain visual reference(s) and/or in-depth description (preferred pose, colours, style, etc.). If no visual reference is available, the price will increase.
- By providing me with the references for your commission, you declare that you have full copyrights or the owner’s permission (this may include fanart) for the usage of the original character design depicted on those references.PAYMENTS AND REFUNDS
- Payment must be made through Invoice on PayPal and in Euros or via ko-fi. Make sure to check conversion rates, if they apply.
- Payment via vGen is made in advance in full.
- If the commission quote amounts to more than 100€ in price, 50% needs to be paid upfront as a security measure.
- Prices are subject to change. If a price for an item were to change after the time of purchase, the client will not be reimbursed or billed the difference.
- If the client wishes to cancel a commission during/right after the sketch stage, a fee of 50% of the base price will apply.
- If the client wishes to cancel a commission due to the finished product being unsatisfactory, a fee of 70% of the base price will apply.
- If the client wishes to cancel a commission close to its completion, a fee of 85% of the base price will apply.
- If the client wishes to cancel a commission, the artist is permitted to reuse the sketch (excluding the client's Intellectual Properties).IMAGE RIGHTS
This section is specific to Personal and Semi-Commercial Uses
- I, plantskid (the artist), reserve the full rights to the copyrighted artwork and its distribution and use.
The artist is allowed, but not limited, to:
• self-promote with the art anywhere.
• use and display the art anywhere (website, social media, portfolio, physical art books, etc.).
- The artist is NOT allowed to:
• claim any Intellectual Property (IP) that doesn’t belong to the artist.
• make further direct profit out of the artwork.- The client is allowed to:
• request that art is NOT posted by the Artist or posted anonymously, or only posted with credit (@) to the Client.
• post their commissioned art on social media with credit (plantskid, any social media @, website) to the artist if no watermark is visible. Credit is always appreciated.
• use their commissioned art as social media icons/banners (Discord, twitter, tumblr, YouTube, etc.) with credit (plantskid, any social media @, website) to the artist if no watermark is visible. Credit is always appreciated.
• use their commissioned art in specific and agreed-upon ways.
• print their commission for personal use only. No distribution rights are given.
- The client is NOT allowed to:
• claim the artwork as their own.
• reproduce/use/resell any part of the artwork commercially in any form (including non-fungible tokens or cryptocurrency).
• use any part of the artwork for promotional and/or advertising purposes.
• alter/edit the artwork without the artist’s explicit permission.
• use art to train AI/ML models.PRIVACY POLICY
I use the information that you provide me with during the process of commissioning to communicate with you and create and send invoices (using PayPal). No other information is collected or stored. Please refer to Paypal's privacy policy for details on services that they provide.
